Standing: Yup. That's one the the doctrines used to dismiss the Trump suits in '20. Laches was another ("you shoild have brought this up earlier"). Laches is out of common law. Carrie Lake got both Laches and ripeness ("naah, it's too soon to do this one"). Dont know what ripeness derives from. Not sure about standing either. Not a fan of standing as a concept. Not a fan of how they all are used to fuck plaintiffs and keep evidence from being heard.

Totally agree. When you look at what Judge Baxter literally requested in order to show standing, she must have had a smirk on her face as she said it. As if any particular voter could possibly prove that their vote was switched or not counted. The secrecy of voting makes that an impossibility.

Thank you so much for painting such a clear picture of where the case stands at this point. Itโ€™s so discouraging how much these guys are up against, but theyโ€™re not alone in it. We must keep pushing. Iโ€™m heartened by the diligent investigations being done, and people such as yourself speaking plainly and often as new developments arise. Thanks again Art.

The unSupreme Court standard for standing in the US, as established in 1992's Lujan, is deliberately and inappropriately difficult to meet to protect the government and the rich from accountability from the average person who is typically the one who's harmed. It's one of many things in the US system that is "rigged" against the average person. Just look at the money it takes to get through the court system, as pointed out by Art; the average person can't afford to fight a case to its conclusion.

Additionally, I suspect that the unSupreme court has long ruled in this way, built up case law in this way, so they can avoid the real elephant in the room; that they have no teeth compared to the other branches of government. The constitution is deeply flawed in this, and many other ways.

Just look at Trump for example. The court must choose to either rule in his favor or face him ignoring their rulings and delegitimizing the court. So they rule in his favor like 92-94% of the time. What they fail to see is that either way they are being delegitimized.

I believe institutional capture is the issue here as well. They know they either go with Trump or face his wrath, and all signs point to Trump's "bloodless revolution" being successful in the end, especially with their help. So rather than stand in the way of the train, they are choosing to either get out of the way or jump on board and hope the ride is a profitable one.

If Trump's coup fails, I'll truly be shocked. And I'll predict this much: If Trump's coup fails in the end, it will only be because he and his appointees decided it wasn't worth it, not because they've been defeated. They hold all the power and can take this coup as far as they want. And they will take it as far as they can stomach. We are at the whims of the stomach, conscience, and satiability of a bunch of sycophantic madmen run by a malignant narcissist who is facing prison if he ever leaves power. Add it up. Thanks for that very thoughtful comment, Afonso. I canโ€™t say I disagree with your prediction. Although, I do suspect that America, being founded on the principles of freedom and democracy, will be a rather difficult country to completely subjugate to the whims of a dictatorship. I suspect that an out and out armed revolution is indeed one possible response to the Trump regime. Itโ€™s hard to say, however, what event might serve as the flashpoint for such a revolution. The American people have already demonstrated an incredible capacity to just accept hardship and hopelessness while they watch Trump and his fellow oligarchs live in unimaginable opulence.

Right. I know from the outside looking in it looks like the American people are sort of just accepting this, but I would argue that's only partially true. Let me explain.

One group supports trump, call that a third (or less) (ignorant accelerationists). One group hates Trump and is in the streets already, call that a third as well. The other third consists of those in the middle who no longer like him, never liked him, or who don't vote at all who don't really know what's happening (this group is shrinking as it gets harder to ignore).

The American people believe in their system and expect it to hold and create an opening for correction at the start of next year with a new liberal congress seated or when Trump leaves office in 2029. I believe if either of those, and especially if both of those are disrupted, that's where the true revolt to regain the country will kick off.

I pray that's not where we're headed but I still see no sign that it isn't where we're headed. Hell, smarter, more educated, and actual historians have said the US is currently headed into a civil war / revolution eventually and saying it's looking like it will be sooner rather than later. I'm just repeating what I'm hearing and adding my own dot-connecting flavor from my political experience and insight.
